The Uniting Church in Australia Act 1977 constitutes the Uniting Church in Australia Property Trust (Q.), of which UnitingCare Qld is a department and Blue Care, which operates Argyle Gardens, is a division of that department.
The Uniting Church in Australia (Church) is formed under the Uniting Church in Australia Act 1977 (Qld) (Act): The Church undertakes activities through various entities and institutions which is governed and controlled through a body corporate established under the Act known as ‘The Uniting Church in Australia Property Trust (Q.)’ (Property Trust). The Property Trust is, by law, capable of:
- suing and being sued;
- acquiring, holding, dealing with and disposing of real and personal property; and
- doing and suffering all such acts and things as bodies corporate may by law do and suffer such as entering into contracts.
Despite containing the word ‘trust’ in its name, the Property Trust is not an un-incorporated entity or an ordinary trust established under a trust instrument.
Each of the entities the Property Trust governs and controls has its own ABN, one of these entities is Blue Care.
